Learned Advocate appearing for the petitioners submits that the husband and the brother-in-law are in custody. There is an application for bail pending in respect of such persons. He submits that the petitioners were falsely implicated. Learned Advocate appearing for the State submits that the police filed charge-sheet. The petitioner no. 2 was not named in the charge-sheet. He draws the attention of the Court to the statement of the victim recorded under Section 161 of the Code of Criminal Procedure and the medical report of the victim. In her statement recorded under Section 161 of the Code of Criminal Procedure, the victim states that she was forcibly poisoned by the accused persons which includes the petitioner nos. 1, 3 and 4. The medical report shows that the victim suffered from poisoning. Considering the gravity of the offence and the involvement of the petitioners therein, we are unable to grant anticipatory bail to the petitioner nos. 1, 3 and 4.
On the prayer of the learned Advocate appearing for the petitioners in CRM 1280 of 2022 is not pressed so far as petitioner no. 2 is concerned.
CRM (A) 1280 of 2022 is dismissed.
