Shri Tuhin Sanyal Ms. Malyasree Maity ...for the petitioner A direction to secure expeditious disposal of two Matrimonial Suits being Matrimonial Suit No.133 of 2017 and Matrimonial Suit No.299 of 2015, now pending before the court of learned Additional District and Sessions Judge, Fast Track 1st Court, Sealdah, is the ultimate relief sought for in this case.

Admittedly, both the suits referred hereinabove are being tried analogously.

It is submitted by the learned advocate for the petitioner that in spite of the matter being posted for peremptory hearing sometime in September 2021, the matter has thereafter not been proceeded towards securing logical conclusion of the case.

In view of the nature of the order proposed to be made, no prior notice upon the opposite party is

considered to be necessary. Service upon the opposite party is thus dispensed with.

Learned Additional District Judge, Fast Track 1st Court, Sealdah, is requested to ensure expeditious disposal of two Matrimonial Suits mentioned hereinabove, now being tried analogously, after causing disposal of interlocutory applications, if there be any pending, providing sufficient opportunity of hearing to either of the parties to this case, but without giving any unnecessary adjournment, unless it is extremely unavoidable.

While endeavouring such exercise, learned court below may proceed with the disposal of the suit in the manner as situation of the case would demand, so as to dispense with the justice in a best possible manner, bearing in mind that the Matrimonial Suits, now being tried analogously, are the product of conjugal relationship between the parties being strained for their matrimonial differences.

Petitioner is directed to make communication of this order to the learned advocate appearing in the court below for the opposite party as well as the learned court below.

With this observation/directions, the revisional application stands disposed of.

Urgent certified photostat copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Subhasis Dasgupta, J.)
