Raju Khatua and others ... petitioners Mr. Abdur Rakib Mr. Mojahid Mehedi ... for the petitioners Mr. Kaushik Kundu Ms. Poulamii Bose ... for the State Mr. Somnath Adhikary Mr. Biswajit Sarkar ... for the applicant No.4 Learned counsels for the accused/petitioners and the de facto complainant/opposite party submit that the disputes that had led to the registration of the FIR have been settled and compromised between the private parties. Therefore, the impugned proceeding should be quashed upon compromise.

Although the charges are under Sections 69/61(2) of the BNS, in the statement of the alleged victim recorded before a learned Magistrate on 20.11.2024, she categorically stated that on a particular day she was forcibly raped by the petitioner No.1. It was only after she tried to resist that a promise to marry was given. When this kind of allegation is levelled by the victim against the main culprit, the proceeding cannot be quashed on the ground of settlement or compromise.

Accordingly, I do not find any merit in this application.

The revisional application is dismissed.
