Criminal Revisional Jurisdiction 29-02-2024 Subha Item no. 74 Ct no.34 CRR 781 of 2024 Sri Rajib Banerjee -versus- Sri Debabrata Banerjee Mr. Anirban Mitra Mr. Aditya Sarkar ....for the petitioner.

Petitioner has deposited a Photostat copy of the demand draft amounting to Rs.4,40,000/-. The same be deposited tomorrow before the learned Judicial Magistrate, 4th court, Durgapur, Paschim Bardhaman in connection with C. R. Case No. 679 of 2015 through a learned lawyer. Notice be issued to the complainant of the case by the learned Judicial Magistrate, 4th court, Durgapur, Paschim Bardhaman. The original demand draft be handed over to the complainant/opposite party. On deposit of the demand draft, the learned Magistrate will keep the warrant of arrest in abeyance and on a report of encashment being submitted the learned Magistrate would recall the warrant of arrest. If with the deposit of the same amount, the judgement dated 30th March, 2023 is complied with so far as the amount is concerned, learned Magistrate would drop the proceedings.

With the aforesaid observations, the revisional application being CRR 781 of 2024 is disposed of.
