The order impugned being Order No. 44 dated January 31, 2024 passed by the learned Additional District Judge, Fast Track 3rd Court at Basirhat, District: 24 Parganas (North) in Title Appeal No. 07 of 2017 refusing to accept some documents without an application under Order XLI Rule 27 of the Code of Civil Procedure does not call for any interference. C.O. 654 of 2024 is thus dismissed without any order as to costs.

This order however will not prevent the petitioner to file a proper application under Order XLI Rule 27 of the Code for reception of additional evidence in the said appeal; if such an application is filed, the appeal Court below shall decide the same in accordance with law.
