Mr. Ayan Banerjee, learned advocate appearing for Bally Municipality, acknowledges that the demolition order was issued without considering the order dated September 23, 2024, passed in the earlier round of litigation in WPA 12392 of 2024 (Ajit Narayan Singh v. State of West Bengal), in which this Court directed the Municipality to consider the prayer for regularisation of the alleged unauthorised portion of the building.

In light of this, the demolition notice dated February 17, 2025, is set aside. The Municipality is

directed to comply with the order dated September 23, 2024, within one month from the date of this order.

Accordingly, WPA 4878 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
