Since the petitioner seeks expeditious disposal of Sessions Trial No.02(1) of 2018 pending before the learned Additional District and Sessions Judge, 1st Court at Alipore, South 24 Parganas, the matter may be taken up for consideration without service of notice upon the opposite parties.

The opposite parties shall not be prejudiced by an order directing expeditious disposal of the case.

The learned counsel takes this court to order passed by the Hon'ble Division Benches of this court on 4th October, 2023 in CRM (DB) 3806 of 2023 and order dated 5th February, 2025 in CRM (DB) 4317 of 2024 respectively wherein the Hon'ble Division Benches have held that the delay in trial is due to dilatory tactics resorted by the accused/private opposite party. The learned counsel submits that the prosecution submitted before the Hon'ble Division Bench that maximum 10 more witnesses are remaining to be examined.

In view of the period of pendency of the case, the learned trial court is directed to take the proceeding to its logical conclusion within one year from the next date of hearing fixed before him without granting any unnecessary adjournment to either of the parties, in accordance with law. The time limit prescribed by this court shall not be exceeded by the learned trial court under any circumstance.

CRR 1021 of 2025 is accordingly disposed of.
