For the petitioner Mr. Arun Kumar Maiti Mr. Subrata Santra ... for the NCB Mr. Maiti, ld. advocate for the NCB, submits that the petitioner did not cooperate with the investigating agency and, subsequently, he is evading the process of law. The trial of the case is in progress and out of the six witnesses, three witnesses have been examined.

Ld. advocate for the petitioner submits that the petitioner intends to surrender before the jurisdictional court.

In view of the undertaking given by the ld. advocate for the petitioner, I direct that, if the petitioner, namely, Mehebul Mallick, surrenders by 10th of January, 2024 and prays for bail, in that case, his application for bail be considered in accordance with law. The proclamation and

attachment already issued be kept in abeyance till 10th of January, 2024.

However, so far as the warrant of arrest is concerned, the same would be in existence and the authorities would be empowered to execute the same. In case, the petitioner do not surrender by 10th of January, 2024, in that case, on and from 11th of January, the earlier order regarding proclamation and attachment will revive and will have its original existence.

The report submitted by Mr. Maiti, ld. advocate for the NCB, be kept with the record.

With the aforesaid observations, CRR 743 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order, duly collected from the official website of the Hon'ble High Court, Calcutta.
