Writ petition is taken up for consideration when learned advocate representing the petitioner has prayed for adjournment and same is refused.

West Bengal Central School Service Commission (for short, "Commission") is represented by learned advocate.

Having considered the submission made on behalf of the Commission, it appears that petitioner participated in 1st State Level Selection Test, 2017 (Headmaster/Headmistress). It is submitted that panel was prepared on 16th January, 2019 which expired on 15th January, 2020. Four years after expiry of panel writ petition was filed on 22nd February, 2024 questioning aforesaid selection process and

prayer is made for permitting the petitioner to participate in counseling.

It is trite law that after expiry of panel candidate loses right to question the selection process and his right to participate in counseling gets extinguished.

In this regard reliance is placed on the judgments of the Hon'ble Supreme Court, one reported in (1996) 9 SCC 309 (State of Uttar Pradesh & Ors. Vs. Harish Chandra & Ors.) and another reported in (2009) 2 SCC 706 (Girdhar Kumar Dadhich & Anr. Vs. State of Rajasthan & Ors.).

Hence, no relief can be granted to the petitioner at this belated stage and the writ petition stands dismissed.

There shall be, however, no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
