The petitioner is in custody for about 160 days. Learned counsel for the petitioner submits that the injured have been discharged from the hospital. Charge sheet has been submitted. Further detention of the petitioner is not required. Learned counsel for the State opposes the prayer. It appears that the petitioner along with the co-accused attacked the victims with a 'Da'. One of the victims was admitted to the hospital for 58 days and has been discharged. Charge sheet has been submitted. Trial is yet to commence. Further detention of the petitioner is not required.
Accordingly, the prayer for bail is allowed.
The petitioner namely Bablu Ghosh @ Handu be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Krishnanagar at Nadia, subject to the condition that he shall appear before the learned trial Court on every date of hearing fixed
by the learned Court and shall not intimidate witnesses or tamper with evidence in any manner whatsoever.
In the event the petitioner fails to appear before the learned trial Court on any date without justifiable cause, the learned trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
The application for bail is disposed of.
