Affidavit-of-service filed on behalf of the petitioner is taken on record.

Learned advocate representing the petitioner expresses concern relating to manner of investigation being carried out by the concerned police authorities in connection with Bidhannagar North P.S. Case No.58 of 2025 dated 21st May, 2025 under certain provisions of Indian Penal Code. Petitioner prays for direction upon the concerned police authorities to expedite the investigation. 3.
Submissions were also made on behalf of the petitioner to point out shortcomings in the investigation relating to the aforesaid criminal prosecution.

State respondents and private respondents are represented by learned advocates.

Learned advocate representing the State respondents has filed a communication dated 16th March, 2026 of Inspector-in-Charge, Bidhannagar North Police Station, Bidhannagar Police Commissionerate and same is taken on record. Copies of the said communication dated 16th March, 2026 are made over to the learned advocates representing the petitioner and the private respondents. 6.
It is disclosed in the said communication dated 16th March, 2026 that notices were issued under Section 35(3) of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, "BNSS") to three accused persons and same were complied with. During the course of investigation, two other persons were found to be involved in the case and they were issued notices under Section 179 of BNSS which were complied with by those accused persons. Thereafter both the accused persons were arrested and forwarded before the jurisdictional Magistrate. 7.
It is further disclosed that on interrogation Investigating Officer did not receive satisfactory reply relating to transactions of sum in connection with the bank account lying in the name of "Rapid Tradelink Private Limited".

It also appears from the said communication dated 16th March, 2026 that notice was also sent under Section
[3] 179/94 of BNSS to the complainant being the petitioner herein and evidence were collected.

In view of steps taken as disclosed in the communication dated 16th March, 2026, at this stage, it ought not to be concluded that Investigating Agency has not taken steps.
10. However, concerned police authority is directed to expedite the investigation in connection with the aforesaid criminal prosecution and submit final report before the jurisdictional Magistrate at an early date.
11. Leave is also granted to the petitioner to approach the jurisdictional Magistrate, if occasion so arises.
12. Writ petition stands disposed of.
13. Urgent photostat certified copy of the order, if applied for, be given to the parties upon usual undertakings. (SAUGATA BHATTACHARYYA, J.)
