The learned Counsel for the appellant has submitted that the appellant is not willing to proceed with the appeal and has placed before us a communication from Sri Pulak Ghosh, the husband of the appellant today at 11:52 AM wherefrom it appears that the appellant has requested the learned Counsel for "closing the case".

In view of such clear instruction, the appeal and the application stand dismissed without any liberty to file afresh on the self-same cause of action. The impugned order, if any, shall stand vacated.

The print out of the email shall be handed over to the Officer of this Court in course of the day and shall form part of the record.
