The petitioner seeks enforcement of an order of injunction passed by the learned Civil Judge (Junior Division), Third Court, Paschim Medinipur.

The Police have been directed to enforce the order of injunction. Finding prima facie case, Police have registered FIR No.67 of 2022 dated 15.03.2022 under the provisions of the IPC and the West Bengal Trees (Protection and Conservation in Non-Forest Areas) Act, 2006.

Investigation has been completed and the Charge Sheet No. 106 of 2022 dated 28.04.2022 has been filed in the matter.

The private respondents in the writ petition submit that they are not the parties to the suit. The Police confirm the same. The
private respondents also submit that they are in occupation of the property for the last 40-50 years.

The private respondents may take appropriate steps in the pending civil suit highlighting their rights in respect of the property, if any.

Pingla Police shall ensure that there is no breach of peace around the suit property and that any order of the Civil Court passed on them specifically is strictly enforced.

The Police report is kept with the record.
8.
The instant writ petition is thus disposed of.
9.
There shall be no order as to costs.
10.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
