No.2 The subject-matter of the present revisional application relates to a challenge to the continuation of Manikchak Police Station Case No.225/2020 dated 26.08.2020 under Sections 441/ 376/ 511/ 506 of the Indian Penal Code. The said case was registered for investigation in the year 2020.

Mr. Datta Gupta, learned advocate appearing for the petitioner challenges the proceedings and more than two years have passed since the case have been instituted at the behest of the opposite party no.2 who is represented by Mr. Sujoy Sarkar, learned advocate. As none appears on behalf of the State, Mrs. Faria Hossain, learned advocate who generally appears on behalf of the State is directed to represent the case for the State. Her appointment may be regularized by concerned authorities.

Having regard to the submissions advanced by the petitioner, learned advocate for the private opposite party no.2 as well as learned advocate for the State, I am of the opinion that the petitioner would be at liberty to canvass the points which has been addressed in this revisional application at the time of consideration of charges before the Jurisdictional Court after receipt of the copies under Section 207 of the Code of Criminal Procedure.

With the aforesaid observations, C.R.R. 543 of 2021 is disposed of. Pending applications, if any, are consequently disposed of. All parties are directed to act on the server copy of this order downloaded from the official website of this Hon'ble Court. (Tirthankar Ghosh, J.)
