18.08.2021 Item no.9 Ct. No.34 CHC C.R.R. No.620 of 2012 (Physical Hearing) In Re: An application under Section 482 of the Code of Criminal Procedure, 1973.

AND In the matter of:- Kishorilal Agarwal ... petitioner Mr. Amitabrata Hait ...for the petitioner Mr. Arijit Ganguly, Mr. Sanjib Kumar Dan ...for the State Report so submitted by the learned advocate for the State be kept with the record.

Learned advocate for the petitioner is present. Mr. Arijit Ganguly, learned advocate appearing for the State has also submitted a report before this Court which reflects that on completion of investigation, report in final form was submitted before the learned Chief Judicial Magistrate, Alipore, South 24 Parganas with the opinion that the allegations which have been made out on investigation reveals that the same is civil in nature.

The report also reflects that the said report under Section 173 of the Code of Criminal Procedure was accepted by the jurisdictional Magistrate on 30.08.2018.

In view of the revisional application being preferred for quashing of the proceedings, I am of the opinion that the same has become infructuous because of the conclusion arrived at by the investigating agency.

Accordingly, the revisional application being C.R.R.620 of 2012 is dismissed.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.

All parties shall act in terms of copy of this order downloaded from the official website of this Court.
