This revision case was preferred by the petitioner challenging the proceedings in case no. C-457 of 2012 corresponding to TR No. 1234 of 2012 under Sections 138/141 of the Negotiable Instruments Act, 1881, which was pending in the Court of the learned Judicial Magistrate, 1st Court at Malda. The petitioner in this revision has prayed for quashing of the entire proceeding as mentioned above. During the pendency of the present revision case, the petitioner who is the accused person in the above complaint case has remitted the entire amount of money as was claimed against him to the tune of Rs. 20 lakhs to the opposite party no.2. The same has been recorded by the trial Court in its order dated 26.09.2016 and the proceedings were dropped. Today a copy of the said order dated 26.09.
2016 along with information slip of the trial Court is filed in Court in support of such contention of the petitioner. Considering the same, it appears that by an account payee draft dated 22.09.2016, the amount of money to the tune of Rs. 20 lakhs has been paid to the opposite party no.2 and the trial Court's proceedings are dropped vide its order dated 26.09.2016.
On consideration of the same ground pleaded by the petitioner in this case it does not appear to be necessary to be dealt with any further and the revision case is now infructuous. Hence, on fact and circumstances of the case, as discussed above, the revision is dismissed being infructuous.
CRR 515 of 2016 is dismissed as infructuous and all connected applications are also dismissed.
Photocopies of the documents are kept with the record. Photostat certified copy of this order, if applied for, be given to the parties on urgent basis.
