The petitioner is serving as Assistant Teacher of Sarfia High Madrasah (H.S.).

The Headmaster of the said Madrasah forwarded a representation of the petitioner to the District Inspector of Schools (Secondary Education), Murshidabad on 27th August, 2015 with request for higher scale of pay in his favour.

The petitioner submits that the said representation has not been considered till date. It has been submitted that similarly situated candidates have already been allowed the Post Graduate scale of pay but no steps have been taken for considering the case of the petitioner.

From the documents annexed to the writ petition it appears that the prayer was made by the Madrasah way back in the year 2015 with request for

higher scale of pay in favour of the petitioner. The same has not been considered till date.

The instant writ petition is accordingly disposed of by directing the District Inspector of Schools, Secondary Education, Murshidabad to consider the prayer of the petitioner for grant of higher scale of pay in his favour strictly in accordance with law, at the earliest, but positively within a period of twelve weeks from the date of communication of a copy of this order.

The said respondent shall pass a reasoned order and communicate the same to the petitioner immediately thereafter.

The petitioner is directed to forward a fresh representation annexing all documents in support of his prayer to the aforesaid respondent for taking a decision in the matter.

The writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
