2021-01-25Hon'Ble Justice Ravi Krishan Kapur2 pages

25.01.2021 25.01.2021 Ct. No.10 b.das W.P.A. 3881 of 2020 Md. M. Hossain Mr. K. P. Mukhopadhyay Mr. S. Maity ....for the petitioner.

Mr. Sarwar Jahan ...for the respondent No.2 Ms. Chaitali Bhattacharya Mr. Rezaul Hossain ...for the State.

The grievance of the petitioner pertains to nonpayment of honorarium. It is alleged on behalf of the petitioner that the petitioner is entitled to honorarium on the basis of M.A. qualification and not on the basis of B.A. qualification.

The State is represented.

It is submitted by Ms. Bhattacharya, appearing on behalf of the State that the petitioner has been paid his entire honorarium.

However, the case of the petitioner for honorarium on the basis of M.A. qualification can be considered by the office of the respondent No.4 being the Additional District Magistrate, Malda.

In view of the submission of the parties I grant liberty to the petitioner to make a representation to the Office of the respondent No.4, who is requested to consider and

dispose of the representation within eight weeks from date of receipt of the same. It is expected that in disposing the proposed representation, the Office of the respondent No.4 will give a right of hearing to all the affected parties and pass a reasoned order in disposing of the same.

It is needless to mention that I have not gone into the merits of the case.

As no affidavits have been called for, the allegations contained in the petition are not admitted.

With the aforesaid directions, WPA 3881 of 2020 is disposed off. However, there shall be no order as to costs. (Ravi Krishan Kapur, J.)
