Advocate, who ordinarily appears on behalf of the State. His appearance may be regularised by the concerned authority. The petitioners claim that they have been falsely implicated in connection with the instant case being Karaya P.S. Case No. 295 of 2022 dated 12.11.2022.

According to the ld. advocate for the petitioners, the complainant and the present petitioner/accused are related to each other and the present case has been purposely instituted because of a dispute arising out of family properties.

The records of the case reflect that a Title Suit was also preferred and till 27th of March, 2023, the same is pending.

Having regard to the fact that the investigation of the case commenced on November, 2022 and, almost 11 months have passed since the initiation of the proceedings of investigation, I am not inclined to interfere with the present revisional application at this stage. However, the petitioners would be at liberty to approach this Court after a report under Section 173 of the Cr.P.C. is filed before the jurisdictional Court and the documents, if any, under Section 207 of the Cr.P.C. is supplied to them.

With the aforesaid observations, CRR 749 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court at Calcutta.
