The matter relates to counter-signature on an inter-state permit for which the petitioner on December 16, 2020 made one application to the Secretary, State Transport Authority.

The grievance of the petitioner is that till date it has not been done and not countersigned that is why he is suffering loss. Today his prayer is for consideration of this application dated December 16, 2020 which is at page 14 of the writ application.

I direct the Secretary, State Transport Authority, West Bengal to consider this application along with other papers that may be produced before him at the time of hearing of this matter, as this matter is to be decided after giving an opportunity of hearing to the petitioner within a period of eight weeks from date. The decision thereon is to be communicated to the petitioner by two weeks thereafter.

Mr. Pantu Deb Roy, Counsel for the respondents has placed before me one judgment delivered by an Hon'ble Judge in WP 14167 (W) of 2016 which order was passed on August 23, 2016. According to him, the lessor's name should be in the registration book which stands in the way of the petitioner.

However, I direct the said Secretary to consider the matter including the judgement placed before me today and to decide the application of the petitioner.

With the above direction, this writ application is dismissed.

There will be no order as to costs.
