The petitioner is aggrieved by the fact that the private respondent no.4 was operating Customer Service Point (CSP) and the petitioner being a Self Help Group deposited a sum of money which aggregates to a sum of Rs.1,30,000/-.

However, all on a sudden, the said CSP was closed and the person operating the same being the respondent no.4 was not traceable.

State has submitted a report

which relates to Goghat P.S. Case No.

60 of 2023 dated 22.02.2023 wherein a case was registered under Sections 420/406 of the IPC as a consequence of 31 victims who were cheated by the respondent no.4 according to the version of the investigating agency. Report also speaks that on conclusion of investigation, Charge-Sheet was submitted before the jurisdictional Court on or about 26.08.2023.

Learned advocate for the State has drawn the attention of the Court to the Serial No of the property description wherein the issue canvassed in the representation made by the present petitioner has been taken into consideration by the investigating authorities while investigating the case.

Learned advocate for the respondent no.4 is present and disputes and denies the accusations.

In view of the police authorities

having taken steps, I am of the opinion that the grievance of the petitioner has been addressed. If there are any other issues which the petitioner intends to commence, it would be in the fitness of circumstances to approach jurisdictional Magistrate, who is in seisin of Goghat P.S. Case No. 60 of 2023.

With the aforesaid observations, WPA 4947 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. A copy of the report be handed over to the learned advocate for the petitioner.
