The petitioner, on the other hand, claims that he intends to construct a boundary wall in terms of a sanction plan. The petitioner, to that effect, referred to an information furnished to the Inspector-in-charge of Joynagar Police Station along with the other administrative authorities dated 05.01.2023.

Having considered that the police authorities would only act pursuant to the directions passed by a court of law or

the appropriate authorities under the West Bengal Land Reforms Act, 1950, I am of the view that the police authorities, in this case, would only restrict themselves to the extent that there should not be any violation of any law and order.

However, if any representation(s) is filed either at the behest of the petitioner or the private respondents, the police authorities would ensure that there is no breach of the peace and/or tranquility taking place as also no untoward incident resulting because of the strained relationship existing between the parties.

So far as the dispute relating to the property is concerned, the right, title, interest, usages and occupation of the property would only be considered by the civil court and/or land authorities and, if any directions are passed, the police authorities would respect, obey and implement such order.

With the aforesaid observations, WPA 4865 of 2023 is disposed of.

Pending application(s), if any, is also disposed of.
