The petitioner relies on the order of the Principal Secretary, Panchayats and Rural Development Department, Government of West Bengal who had recommended his appointment on compassionate ground in a Group - C post, as a special case.
The order was subject to recommendation by the Commissioner, Panchayats and Rural Development Department, upon obtaining concurrence from the competent authority.
It appears that the petitioner has not yet been provided any employment nor has the petitioner been intimated whether such recommendation was ever made by the Commissioner or the competent authority or whether the petitioner's case had been rejected by the said authority or not.
Under such circumstances, the writ petition is disposed of by directing the Commissioner,
Panchayats and Rural Development Department to treat the writ petition as a representation and dispose of the same in accordance with law upon granting an opportunity of hearing to the petitioner, to the authorized representative of the Dakshin Dinajpur Zilla Parishad and also to the concerned District Panchayat and Rural Development Officer, Dakshin Dinajpur.
reasoned order shall be passed and communicated to the petitioner.
The entire exercise shall be completed within a period of eight weeks from the date of communication of this order.
It is made clear that the time frame mentioned hereinabove is mandatory as the petitioner has been waiting for a long time.
A copy of the writ petition be served upon the Commissioner, Panchayats and Rural Development Department for necessary compliance.
The writ petition is disposed of.
There will be no order as to costs.
All the parties are directed to act on the basis of the server copy of this order.
