Affidavit of service filed by the appellant is taken on record.

The present Intra Court Appeal is filed against the order dated 09.02.2026 passed by the Hon'ble Single Judge. The Writ Court was not inclined to pass any interim order.

We find from the order dated 09.02.2026 that the Hon'ble Single Judge considered the provisions contained in the Paschim Banga Gramin Bank (Employees') Pension (Amendment) Regulations, 2024. Upon consideration of the provisions prima facie the Hon'ble Single Judge found that there was a provision in the Regulation providing for adjustment from the pension which is being paid and, therefore, declined the interim order in the following terms:

"4. Prima facie it appears on consideration of Regulation 6 read with Regulation 3(1) of the said Regulations of 2024 that there are provisions for adjustments from the pension

which is being paid in terms of said Regulations of 2024 by the bank authorities."

We further find that on the said date the learned advocate for the writ petitioners/appellants herein sought adjournment to file composite affidavit-in-reply, which the learned advocate for the appellants has till date has not served on the advocate for the bank. 5.

In the circumstances we find that no case is made out by the appellants for interfering with the order dated 09.02.2026.

The appeal is dismissed. Pending application is also dismissed.

We make it clear that the present order may not be taken as an expression of opinion by this Court on the merits of the pending writ petition which is to be considered in accordance with law.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
