The petitioner's grievance is that the private respondents, who own and occupy the land adjacent to the petitioner, is digging a pond therein though the land is an agricultural land, thereby changing the nature and character of the land.

The petitioner filed an application before the respondent no.3 on 18th August, 2017 ventilating his grievance but the said application has not been considered till date.

Having considered the submissions made on behalf of the parties and material on record, I dispose of the writ petition with a direction upon the respondent no.3 to consider and dispose of the application after giving an opportunity of hearing to all the affected parties including the petitioner, within a period of two months from the date of communication of this order, in accordance with law.

WPA 3866 of 2018 is disposed of. However, there shall be no order as to costs.

Since no affidavit has been invited, the allegations made in the writ petition are deemed to be not admitted.

Urgent certified website copy of this order, if applied for, be given to the parties upon compliance of all formalities.
