Advocate for the petitioner is aggrieved by the fact that the complaint case being no. 762 of 2016 pending before the ld. JM, 2nd Court, Howrah, was initiated in the year 2016 and in spite of the evidence of the complainant having commenced, but, till date, the evidence of p.w.1 has not been completed.

It has been informed that the next date is fixed on 23rd of April, 2024.

Having considered the fact that more than seven years have passed since the initiation of the case and the very purpose of the legislature in incorporating the aforesaid provision under the Act itself is delayed, I direct the ld. Court to fix at least one date in a week so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. All efforts be taken by the ld. JM, 2nd Court, Howrah to conclude the trial by 31st of December, 2024.

With the aforesaid observations, CRR 791 of 2024 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
