Wasim Akram, Mr. Akash Ghosh ....for the petitioner Ms. Sujata Das ....for the State The grievance of the petitioner is that the case diary in CRR No.580 of 2017 was not being traceable, for which, the petitioner has not been able to prepare informal paper books as directed by this court.

It was recorded in the order dated March 01, 2022 that the court observed that the petitioner shall serve a fresh notice on learned counsel for the State indicating that the matter shall next be enlisted under the same heading on March 08, 2022, by which date it was expected that counsel for the State shall hand over all relevant copies in her/his custody pertaining to the matter to their counterpart appearing for the petitioner.

However, subsequently, the State submitted that the case diary was not traceable, which position changed later on, on the case diary having been traced out, as submitted by learned counsel for the State on June 17, 2022.

Since the case diary is now available, the office is directed to furnish copies of all relevant documents to the learned Advocate for the petitioner for perusal, if so required by learned counsel for the petitioner, within a week from date. Thereafter, the office shall take immediate steps for sending down the relevant records of the case to the trial court as expeditiously as possible, positively within a month from the date of inspection by learned counsel for the petitioner. For the said purpose, learned counsel for the parties are requested to cooperate with the department by handing over all documents, if any, required by the department to comply with this order.

Moreover, in the event the petitioner is otherwise entitled to copies of any of the documents in the records, the office, upon such request being made by the petitioner/his advocate, hand over copies of such documents to the petitioner and/or the learned Advocate for the petitioner as per such request, also within a week from date.

Accordingly, CRR No.580 of 2017 is disposed of with the above directions.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
