Mr. Pawan Kumar Gupta, learned Advocate representing the petitioner/accused prays for bail submitting that the petitioner is the husband of the deceased victim, who herself committed suicide, though the petitioner has been falsely alleged to have committed murder in respect of his wife/deceased. It is further submitted that the charge sheet has been submitted requiring no further detention at this stage.

Learned Public Prosecutor representing the State draws our attention to the Post Mortem report and some statements of the neighbouring witnesses of the locality, where the occurrence was held, wherefrom it is found that the death was due to manual strangulation, which is anti mortem and homicidal in nature. Having considered the submission of both sides and bearing in mind the direct involvement of the petitioner in the alleged offence together with the seriousness of the offence, which has already been reflected in the Post Mortem report, we are not inclined to grant bail to the petitioner.

The prayer for bail of the petitioner is rejected at this stage. The application for bail, being CRM 2144 of 2021, is thus rejected.
