The order in contempt dated 15th December, 2022 directed the respondents in the writ petition to consider the representation of the petitioner and dispose of the same within a certain timeframe. The Zonal Manager of the Bank was to pass a reasoned order after hearing the petitioner and was to communicate the reasoned order to the petitioner within the timeframe directed in the order.

Learned counsel for the applicant/petitioner placed a communication dated 28th August, 2023 of the Chief Manager, Punjab National Bank. Counsel submits that the applicant/petitioner was not heard by the said Bank and the alleged contemnors are hence in the contempt.

However, after perusing the order, it appears that the applicant/petitioner was given several hearings

upon visiting the Branch of the Bank and was also communicated the inability of the Bank to close the concerned account for the reasons indicated in the communication dated 28th August, 2023. It does not appear from the said communication that the concerned official proceeded to come to a decision without hearing the applicant/petitioner.

If the applicant/petitioner continues to have any grievance against the alleged contemnors/respondents or against the Punjab National Bank, the petitioner has to approach the appropriate court.

CPAN 266 of 2023 is, accordingly, disposed of in terms of the above.
