Learned advocate also submit that although charge has been framed but no witness till date has been examined.

It has been contended that the petitioner has been implicated for alleged recovery of 291 gm of heroin. Learned advocate for the State opposes the prayer for bail and submits that charges have been framed and next schedule is fixed in the month of June, 2026. Having considered that date has already been fixed, some opportunity must be granted to the prosecution. Accordingly, I direct that the prosecution would pray for preponing of the evidence of the seizure list witnesses on the next schedule.

The petitioner would be at liberty to approach this court after the evidence of the seizure list witnesses is over. With the aforesaid observations, CRM(NDPS) 407 of 2026 is disposed of.
