The State of West Bengal and anr.

Mr. Pravas Bhattacharya Mr. MFA Begg...........for the State Report submitted by the State is taken on record. Nobody appears on behalf of the petitioner on call. Even on earlier occasion no one represented the petitioner, no accommodation sought for.

This is an application filed by the petitioner under section 482 of the Criminal Procedure Code, 1973 seeking quashing of the proceeding of G.R Case no. 2542 of 2000 arising out of Jorabagan police station case no. 308 dated 23.12.2000 under sections 341/454/380/427/506(II)/34 of the IPC, 1860 pending before the learned Metropolitan Magistrate, 17th Court at Calcutta.

This case pertains to the year 2017. As per report filed by the State, the case record is lying with the court and the matter has been fixed before the learned trial court on 23rd April, 2024 for evidence.

However, no one represented the petitioner, no accommodation sought for in spite of giving several opportunities.

In view of the aforesaid facts it seems the petitioner is no more interested to proceed with the instant case. Accordingly, CRR 586 of 2017 is dismissed for default.

Interim order, if any, stands vacated.

Let a copy of this order be communicated to the learned court below immediately for information and taking necessary action.

Liberty is granted to all parties to act in terms of the copy of this order downloaded from the official website of this court.
