Petitioner approached this court as after obtaining a decree from the civil court, he was thrown out from the shop room concerned, assaulted mercilessly and dispossessed. To that effect, a complaint was lodged with the Superintendent of Police, Diamond Harbour and the Inspector-inCharge, Bishnupur Police Station. I find that over the issue, Bishnupur PS Case No.

103/23 dated 05.02.2023 has been registered for investigation. It is also reflected from the report that Misc. Appeal No. 413 of 2022 was preferred before the learned District Judge, Alipore wherein there has been a direction for status quo in respect of the possession of the suit property.

The Superintendent of Police, Diamond Harbour Police District would trace out the progress of the case of Bishnupur PS Case No. 103/23 and ensure that if charge sheet has not been submitted, charge sheet be submitted within a period of 60 days and if charge sheet has been submitted, a special public prosecutor be engaged for conducting the trial. The learned Magistrate in seisin of the matter would fix one date in every 15 days so that the trial is taken to its logical conclusion within a reasonable period of time.

With the aforesaid observations WPA 4880 of 2023 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
