Ms. Faria Hossain Mr. Aniket Mitra For the State Apprehending arrest in connection with Domjur Police Station case no. 351 of 2019 dated 10.06.2019 under Sections 363/365 of the Indian Penal Code, the present application has been preferred.

Mr. Chakraborty, learned advocate appearing for the petitioners submits that the petitioner had a love affair with the daughter of the de facto complainant and he had been falsely implicated. The allegations levelled against the petitioners are unfounded. Upon completion of investigation charge sheet has also been submitted and as such custodial interrogation is not necessary.

Mr. Mitra, learned advocate appearing for the State opposes the petitioners' prayer for anticipatory bail and draws our attention to the statement of the victim girl as recorded under Section 164 of the Code of Criminal Procedure. Having heard the learned advocates appearing for the

parties and considering the materials in the case diary including the statement of the victim girl as recorded under Section 164 of the Code of Criminal Procedure, the gravity of the offence and the extent of complicity of the petitioner in the alleged offence, we are not inclined to grant anticipatory bail to the petitioner. Accordingly, the application for anticipatory bail being CRM 2143 of 2021 is dismissed.
