I sent this matter for consideration by the Commissioner of School Education who has stated that because of the age bar, the petitioner cannot be given appointment. The age of the petitioner at the time of the death of her husband was 45 years 9 months, that is why she cannot be considered for the compassionate appointment.

The daughter of the petitioner is studying MBBS in a Government Medical College and the son of the petitioner is studying B.Tech. in Kalyani Government Engineering College.

Therefore, I think that the family has tide over the crisis for which compassionate appointments are made.

Pursuant to my direction a copy of the said notification No. 57-SE dated 15.01.2002 has been produced before me by Mr. Dhole, the learned advocate for the State, which I have perused.

Considering the facts and circumstances of the case, I cannot pass any order in favour of the petitioner. With the above observation, this writ application is disposed of.
