Allowed submits that the petitioner is in custody since 4th January, 2025. Charge-sheet has already been submitted and the case is yet to be committed to the court of sessions, as such, petitioner prays for bail on any stringent conditions.
Learned advocate for the State has opposed the prayer for bail and drawn the attention of the Court to the statement of Abir Mallick, an injured as also Matabbar Sk. I have taken into account the statement of the same witnesses and the materials appearing on record. From the record, it reflects that the genesis of the dispute was over trivial issues relating to the son and the grand-son as a result of which the
present petitioner assaulted with a branch of a tree/wooden stick, consequent to which the victim succumbed to injuries. There are other accused persons which is not relevant for consideration of the bail of the present petitioner but having considered the genesis of the case and primarily no antecedents of the petitioner reflecting from the record, I am of the opinion that the petitioner must get an opportunity of civil life. As such, the prayer for bail of the petitioner is allowed. The petitioner, namely, Sekh Akkel Ali @ Akkel Sekh @ Akkel Sk @ Sk. Akkel Ali shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned ACJM, Kalna.
If on bail, the petitioner shall be physically present on each and every date fixed before the learned court and shall not leave the district of Purba Bardhaman without prior permission of the learned court. Additionally, the petitioner shall not enter into the jurisdiction of Monteswar Police Station till further orders of this Court.
Accordingly, CRM(M) 596 of 2026 is allowed.
