The appellant is not represented either physically or on virtual mode, nor any accommodation is prayed for.

On 27th January, 2021 the appellant was also not represented when we made it clear that in the event the appellant is not represented on the adjourned date the matter may be dismissed. The appeal was filed on 20th February, 2018 against dismissal of the application for injunction filed under Order 39 Rule 1 & 2 of the C.P.C. The said appeal was initially filed without any application for condonation of delay.

However, subsequently an application for condonation of delay was filed.

On such consideration, the application for condonation of delay being CAN 1 of 2018 is dismissed for default. Consequently, the appeal stands rejected.
