Mr. Kanishk Sinha Ms. Lipika Das Mr. Dipankar Ray ....for the Petitioners Ms. Soni Ojha ....for the Respondent No. 1 and 2 The grievance of the petitioner is primarily directed against a proceeding pending before the Debt Recovery Tribunal being S.A. No. 2487 of 2025.

There is also an incidental prayer for stay of any coercive measure under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (in short SARFAESI Act).

It is fairly submitted by Mr. Sinha appearing on behalf of the petitioner that the only prayer is for expeditious disposal of the pending application before the Debt Recovery Tribunal. This is not opposed by the respondent no.1.

In such circumstances, WPA 5246 of 2026 stands disposed of by directing expeditious disposal of S.A. No. 2487 of 2025 within a period of three months from the date of passing of this order.

It is made clear that this order is not to be treated as a resistant or embargo or stay of any kind in respect of any measure under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (in short SARFAESI Act).

It is made clear that there has been no expression on the merits of the case and all issues are left open to be decided by the Debt Recovery Tribunal in accordance with law.
