1. We have heard Mr. Banerjee, learned advocate for the petitioner, Mr. Basu Mallick, learned advocate for the State and Mr. Ganguli, learned advocate for the respondent no. 5.

2. Learned advocate appearing for Pradhan, Sitalpur Gram Panchayat on written instruction dated January 13, 2025 submitted that there are certain defects in the impugned work order and therefore, he seeks to withdraw the impugned tender.

3. Accordingly, the tender, which has been challenged in this writ petition stands set aside leaving it open to the Gram Panchayat to float a fresh tender in accordance with law.

4. With the above observations, the writ petitions stand disposed of.

5. The written instruction given by Pradhan of Sitalpur Gram Panchayat is kept with the records.

6. No costs.

7. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
