And In the matter of: Kabiruddin Mandal @ Kobir Sk. ... petitioner Mr. Atis Kumar Biswas Ms. Jyoti Agarwal ... for the petitioner Mr. Provash Bhattacharjee Mr. Sourat Nandy ... for the State Learned counsel for the petitioner submits that there was a backlash following a murder that had taken place in the area and the subsequent incident led to the registration of the present FIR. Nine persons have been mentioned in the charge-sheet. The petitioner stands on the same footing as a co-accused who has been granted anticipatory bail by the learned Sessions Court.

Learned counsel for the State vehemently opposes the prayer for anticipatory bail, relies on the case diary and refers to the statements of the victim and other eyewitnesses, the injury report and the CT scan report of one of the victims, which shows a skull fracture. He submits that two persons were injured and the said victim had to remain in hospital for 24 days.

Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
