The charge is under Sections 21(C)/29 of the NDPS Act, 1985. The petitioner was arrested on the basis of statement made by the co-accused. There was no recovery from the petitioner. The coaccused, on the basis of whose statement the petitioner was arrested, has been granted bail by this Court by an order dated November 19, 2020 passed in CRM 8645 of 2020.

We have seen the memo of evidence.

We have heard learned counsel for the parties. We are of the opinion that this is a fit case where the petitioner may be enlarged on bail but on conditions.

Accordingly, the petitioner shall be released on bail subject to furnishing bail bond of Rs.10,000/- (rupees ten thousand) along with two sureties of like amount each, one of whom must be local, to the satisfaction of the appropriate Court in Malda. The petitioner must attend every date fixed for trial. The petitioner shall also report to the local Police Station once in fifteen days. In the event of any unexplained

absence of the petitioner, the trial court will be entitled to cancel the bail without reference to this court.

CRM 2163 of 2021 is, accordingly, allowed.
