Ranjan Saha Mr. Debajyoti Deb Mr. Abhisek Roy Chowdhury Mr. Somdyuti Parekh ...for the petitioner This application under Article of the Constitution of India is at the instance of the defendant praying for a direction upon the learned Civil Judge (Jr. Div.), 1st Court, Alipore to dispose of the Title Suit No.59 of 2014 expeditiously.

It appears from the record that on repeated occasions the parties were not present at the time of call and for which the hearing of the suit had to be adjourned. From the order sheets appended to the civil revision application it appears that March 3, 2025 was fixed for filing of the written statement by the plaintiff in respect of the counter-claim.

On a query of the Court the learned advocate appearing for the petitioner could not apprise this Court as to what happened on March 3, 2025.

In view of the order sought and proposed to be passed this Court feels that there is no necessity to direct issuance of any notice upon the opposite party. However,

the learned advocate on record of the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or the learned advocate representing him before the learned Trial Judge. The learned Civil Judge (Jr. Div.), 1st Court, Alipore is requested to make an endeavor to dispose of Title Suit No.59 of 2014 as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

CO 762 of 2025 stands disposed of.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
