Learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with the instant case on the basis of statement of co-accused. It has also been submitted that the subject matter of the case relates to alleged recovery of 192.900 kgs. of ganja. Petitioner is innocent and he should be released on bail.

Learned advocate for the State opposes the prayer for bail and submits that there are call data records and the petitioner has antecedent.

Learned advocate for the petitioner submits that so far as earlier case is concerned, the petitioner has been granted bail. However, having regard to the fact that the mobile of the

co-accused with whom the petitioner was having conversation has been sent for forensic examination and the fact that charges till date have not been framed, I am not inclined to release the petitioner on bail at this stage.

Accordingly, CRM(NDPS)413 of 2026 is dismissed at this stage.
