It is the grievance of the petitioners that their neighbours, Respondent Nos. 9 to 12, have undertaken unauthorised construction on L.R. Plot No. 1616, J.L. No. 124, P.S. - Duttapukur, District - North 24 Parganas, without obtaining any permission from the concerned Panchayat.

Respondent Nos. 9 to 12 are not represented before this Court.

It appears that the petitioners had submitted a representation dated 9th December, 2025 before the Panchayat Pradhan, Duttapukur No. 2 Gram Panchayat, North 24 Parganas, inter alia alleging that Respondent Nos. 9 to 12 had commenced construction by encroaching upon a

portion of the land owned by the petitioners, without any permission from the Panchayat Authority.

Learned advocate appearing for the petitioners submits that, despite such representation, no steps have been taken by the Panchayat Pradhan.

In view of the aforesaid, the writ petition is disposed of with a direction upon the Panchayat Pradhan, Duttapukur No. 2 Gram Panchayat, Respondent No. 8, to consider the representation appearing at page 17 of the writ petition in accordance with law.

If it is found that Respondent Nos. 9 to 12 have undertaken any unauthorised construction on the relevant plot, the Pradhan shall refer the matter to the concerned Sub-Divisional Officer in terms of Section 23(5) of the West Bengal Panchayat Act, 1973, within a period of two weeks from the date of communication of this order.

Accordingly, WPA 5030 of 2025 stands disposed of.
