Report submitted by the Officer-in-Charge, Posta Police Station, Kolkata through the learned advocate appering for the State be kept with the record.
The revisional application was preferred against the final report being submitted by the police authorities with a prayer under Section 173(8) of the Code of Criminal Procedure which was dismissed by the learned Magistrate. Having regard to the fact that the subject matter of the case relates to dishonour of cheque and more than 12 years have been passed since the date of the incident, there is no issue for directing the police authorities for further investigation.
The petitioner would be at libety to file a private compliant in order to prove its contention.
With the aforesaid directions, the present revisional application being CRR 658 of 2011 is disposed of. All pending applications, if any, in connection with revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.
