AD 59 April 8, 2026 Ct. 28 SG CRM(A) 727 of 2026 Allowed An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Shyampur P.S. Case No.485 of 2025 dated 28.08.2025 under Sections 329(4)/117(2)/118(1)/109/351(3)/3(5) of the BNS, 2023.
And In the matter of: Afroja Begum and others ... petitioners Mr. Kunal Ganguly ... for the petitioners Ms. Sukanya Bhattacharya Ms. Suruchi Saha ... for the State Learned counsel for the petitioners submits that there was a delay of 14 days in lodging the FIR. The petitioner Nos.1, 2, 3 and 6 are female members of the family. The incident relates to a scuffle between the family members. Learned counsel for the State opposes the prayer for anticipatory bail and relies on the statement of the victim and the injury report which, hoewever, does not show infliction of any grievous injury.
Considering the above, the other materials available in the case diary and the alleged role ascribed to each of the petitioners, while I am inclined to grant anticipatory bail to the petitioners, the movement of the petitioner No.4 shall remain restricted for a limited period.
In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioners shall cooperate with the investigation, shall not threaten or intimidate witnesses, the petitioner Nos.4, 5 and 7 shall meet the investigating officer once a fortnight till submission of report in final form and the petitioner No.4 shall stay outside the jurisdiction of Shyampur Police Station for a period of two months except for attending the jurisdictional court or meeting the investigating officer.
The application for anticipatory bail is, thus, allowed. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
