Petitioner approached this Court as the information submitted with Bharatpur Police Station did not yield any result. I find that such information was furnished on or about 29th January, 2025. Police authorities have submitted their report. Report reflects that a Title Suit No.71 of 2023 is pending before the learned Civil Judge (Junior Division), 1st Court, Kandi, Murshidabad. Earlier proceedings were drawn up under Sections 126/135 of the BNSS against the private respondent no.5. Report also reflects that a proceeding being Bharatpur P.S. Case No.56 of 2025 has been registered on or about 06.03.2025 and the investigation of the case was in progress.

Learned advocate for the private respondent nos.5 and 6 submits that there is a long standing

dispute amongst the relations and the petitioner is trying to use the police authorities for establishing her dominion relating to the property-in-dispute. Having considered that the police authorities have already registered a criminal case against the private respondents and that a civil court is already in seisin of the issue, I direct that the police authorities will only interfere if there is violation of law and order so that the situation at any point of time is not blown out of proportion.

With the aforesaid observations, WPA 5031 of 2025 is disposed of.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
