Learned Advocate appearing for the petitioners submits that both the petitioners are female with the 2nd petitioner having a baby of two years of age. He submits that two other co-accused were granted either bail or anticipatory bail.
Learned Advocate appearing for the State draws the attention of the Court to the injury report. He submits that the police are investigating inter alia under Section 314 of the Indian Penal Code. The injury report corroborates the allegations of the de facto complainant. He refers to the statement of the victim recorded under Section 161 of the Code of Criminal Procedure.
Considering the gravity of the offence and the involvement of the petitioners therein and considering the injury report of the victim and her statement recorded under Section 161 of the Code of Criminal Procedure, implicating the petitioners we are unable to grant anticipatory bail to the petitioners.
CRM (A) 1296 of 2022 is rejected.
