In view of a sufficient prima facie case having been made out regarding delay in disposal of the petitioners' suit in the court below, which is implicitly urgent in view of a prayer for eviction having been made therein, CO No.451 of 2021 is disposed of by requesting the Civil Judge (Junior Division), First Court at Medinipur, District: Paschim Medinipur to dispose of Other Suit No.12 of 2014 pending in the said court as expeditiously as possible, positively within one year from the date of communication of this order to the court below.

The petitioners shall communicate this order, along with a server copy thereof, on the opposite party as well as the court below at the earliest. The court below as well as the parties shall act on the written communication of the learned advocate for the petitioners along with server copy of this order, without insisting upon prior production of a certified copy thereof.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
