"I-Jha," Satgachia Market Complex, Howrah.

It is an undisputed fact that the petitioner and respondent no. 10 are brothers.

Learned counsel appearing for WBSEDCL submits that respondent no. 10 has been enjoying the electricity connection since August 24, 2010. Learned counsel appearing for the petitioner submits that the petitioner is the leaseholder in respect of the said shop room.

Since the possession of respondent no. 10 is not in dispute, and considering that he has been availing of electricity services for approximately fifteen years, I am not inclined to direct disconnection of the

electricity supply at the instance of the petitioner. It is clarified, however, that the electricity connection in favour of respondent no. 10 does not confer upon him any right, title, or interest in respect of the said shop room.

If any dispute arises regarding the right, title, or interest pertaining to the said shop room, the same may be adjudicated by the competent Civil Court, notwithstanding the fact that respondent no. 10 continues to hold an electricity connection.

Accordingly, WPA 5680 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
