Mr. Debabrata Roy ...for the petitioners This application under Article of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Div.), 2nd Court, Sealdah to dispose the application filed under Order 39 Rule 1 and 2 of the Code of Civil Procedure in Title Suit No.230 of 2024 expeditiously.
From the order sheets appended to the civil revision application this Court finds that February 27, 2025 has been fixed for hearing of the injunction application. The learned advocate appearing for the petitioner submits that the injunction application was not taken up for hearing on February 27, 2025 and a date has been fixed for hearing of such application sometimes in the month of April, 2025.
In view of the order sought and proposed to be passed this Court feels that there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate on record of the petitioner shall be obliged to forward a copy of this application along
with this order upon the opposite parties or the learned advocates representing the opposite parties before the learned Trial Judge.
It has been submitted by the learned advocate appearing for the petitioner that the injunction application is otherwise ready for hearing and the same is pending since June, 2024.
In view thereof CO 765 of 2025 is disposed of by requesting the learned Civil Judge (Jr. Div.), 2nd Court, Sealdah to take up the hearing of the injunction application on the next date fixed and to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. There will be no order as to costs.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
